Aim and description of our Services

Autos Bahia Marbella s.l. hold all the rights to the website found at malaga-airport-transfers.com (hereinafter defined as “the Website”).
These terms and conditions regulate the management and reservation of passenger land transportation services provided by Autos Bahia Marbella s.l..
Regulations
These General Conditions have been prepared in accordance with what has been established in Law 34/2002, regarding services to the information society and electronic commerce; Law 7/1998, pertaining to General Conditions of Contract; the Royal Decree 1906/1999 which regulates telephone or electronic contracts with general conditions developed from article 5.3 of Law 7/1998; General Law 26/1984 for the Defence of Consumers and Users; Law 7/1996, the Retail Trade Regulation Act; and any other legal disposition which may be applicable.
Autos Bahia Marbella s.l. is able to modify these General Conditions by publishing said changes on the website malaga-airport-transfers.com, on the version published by Autos Bahia Marbella s.l. at the time a user accesses the website.
If any of the clauses in these general conditions were to be declared void or null, totally or partially, said nullity or ineffectiveness will apply only to that particular provision or section of it which is void or ineffective. All other parts of the general conditions will remain in force, with the affected provision or section of it not being taken into consideration.
Contracting procedure
By submitting the information which we request via our online booking form, you are entering into the contract for the transportation service, where these relevant stated conditions apply.
Following this act, you will receive an email with information from our central booking office, and you will be able to verify that your personal data and that of the services are fully correct. The entire booking procedure is completed in the English language.
Cancelations and/or changes
In case of any error when entering the contract for the service, or if there is a mistake in the entered data or conditions of the contract, it will be freely possible to amend those mistakes or cancel the service for which the contract was entered by replying to the received email. Such cancellation will not generate any cost to the user.
General conditions
The user’s request to enter into a contract for the service implies an agreement to the present Terms and Conditions and the rest of the Conditions which regulate the use of said Website. This is formalized when the booking takes place.
Price
The cost of the services offered on malaga-airport-transfers.com will be the one that is applicable for each of those services and will remain in force for as long as they are accessible via Autos Bahia Marbella s.l.’s Website. This entity reserves the right to modify said rates at any time. The changes in price will be applicable from the time that they are incorporated into the aforementioned Website.
Service rendering
The rendering of specific transport services contracted by the user shall take place in the manner in which they are described in their respective descriptions.
Responsibility for the transfer service
Autos Bahia Marbella s.l. limits itself to informing the user of the specific offers regarding services offered by third party companies (suppliers), as well as managing the bookings for these services. Transfer bookings made by the user will be contracted to a specific passenger transport company (supplier). Therefore, at no time will Autos Bahia Marbella s.l. be held responsible for issues related to the rendering of the service, such as:
Baggage loss or damage.
Lack of punctuality.
Changes in the service contracted for.
Problems or accidents which occur during the journey.
In these cases, the responsible entity will exclusively be the passenger transport company (supplier) rendering the service. Thus, Autos Bahia Marbella s.l. will provide the user with all the details of such transport company (supplier) to enable the user to make any claims which may be appropriate to the case.
Jurisdiction
These General Conditions are governed by Spanish law. The parts are submitted, at their election, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the user’s place of residence.
Privacy Note
In compliance with the dispositions of article 5 of the Organic Law 15/1999, of December 13th, regarding Personal Data Protection, we inform you that the information which is collected via this online form will be included on a File duly inscribed before the Spanish Data Protection Agency. This will be done under the responsibility of Autos Bahia Marbella s.l., with the purpose of managing your passenger transport service reservation with a third party company, as well as to keep you informed of promotions and news which may be of your interest and for which you give us your express consent.
We also inform you that your information will be passed on to the relevant transport companies (suppliers) in order to manage and carry out the purpose indicated.
